Temple announce improvements to its ATE Insurance Product for Clinical Negligence Litigation

20 May 2009

Following a product review in early 2009, Temple have launched a new ATE clinical negligence delegated authority scheme to work in conjunction with all types of litigation funding, such as BTE Insurance and Legal Aid, to ensure that we are able to offer the most flexible clinical negligence product on the market.

Temple’s Clinical Negligence delegated authority scheme now provides you with:

  • The ability to issue policies for cases with prospects of success of 51% or above;

  • A delegated ‘top-up facility’, which allows you to issue policies where Legal Aid is withdrawn or where BTE insurance becomes exhausted;

  • A delegated ‘top-up indemnity’ facility, which enables you to top-up cover to a maximum of £250,000 without any referral to Temple;

  • A significantly reduced premium in the event that there are early admissions of liability and causation, starting from £525 for £100,000 of cover;

  • Full Part 36 cover for all cases;

  • The ability to issue policies where there are up to three opponents and for damages up to £5,000,000 without referral to Temple;

  • The ability to issue policies on the basis of a positive report from an in-house nurse/doctor or preliminary expert evidence.

Paul Bonner, a Director in the ATE Underwriting division commented that, “This scheme has been designed with leading law-firms in mind and will allow them to ensure that their clients have seamless protection against adverse costs orders, no matter how their legal action has previously been funded.”
